These Terms of Service (“Terms”) govern your access to and use of Noticd's website and services (the “Service”). By using the Service, you agree to these Terms.
The service
Noticd helps you find prospects, generate personalised outbound emails, and send campaigns through managed sending infrastructure. Features and availability may change as we improve the Service.
Accounts
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You must provide accurate information and promptly update it as needed.
Acceptable use
- You will use the Service in compliance with applicable laws, including anti-spam and data-protection laws (such as GDPR, PECR and CAN-SPAM).
- You will only contact prospects where you have a lawful basis to do so, and you will honour opt-out requests.
- You will not use the Service to send unlawful, deceptive, or malicious content.
You are responsible for the content of messages sent through your account and for ensuring your outreach complies with the law.
Plans and payment
Paid plans are billed monthly in advance and renew automatically until cancelled in line with the plan terms agreed when you sign up. Fees are non-refundable except where required by law.
Intellectual property
We retain all rights in the Service and our underlying technology. You retain ownership of the data and content you provide. You grant us a licence to process that content solely to provide the Service.
Disclaimers and liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.
Termination
We may suspend or terminate access if these Terms are breached. You may stop using the Service at any time.
Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts.
